The EB-5 Program is a United States immigration program that allows foreign investors to obtain a green card by investing in a new commercial enterprise that creates at least 10 jobs for U.S. workers.

· To initiate the EB-5 process, investors must file Form I-526, Immigrant Petition by Alien Investor, with USCIS. This petition demonstrates eligibility and provides details about the investment.
· Upon approval of the I-526 petition, investors, and their immediate family members (spouse and unmarried children under 21) are granted conditional permanent resident status, which is valid for two years.
· To remove the conditions on their permanent residency and become unconditional permanent residents, investors must file Form I-829, Petition by Entrepreneur to Remove Conditions, within the 90-day period immediately preceding the second anniversary of their admission as conditional permanent residents.
· If the I-829 petition is approved, USCIS removes the conditions on the green cards, and investors and their families become unconditional permanent residents.
· Unconditional permanent residency grants the same rights and privileges as other lawful permanent residents, including the ability to live and work in the U.S. indefinitely.
After obtaining unconditional permanent residency, EB-5 investors and their family members can choose to pursue U.S. citizenship through the naturalization process.
Eligible permanent residents can apply for U.S. citizenship by submitting Form N-400, Application for Naturalization, to USCIS.
· USCIS reviews the application, conducts background checks, and schedules interviews and tests as necessary.
· If the application is approved, the applicant takes the Oath of Allegiance to become a U.S. citizen.
