EB-5 program provides a pathway to permanent residency in the United States, but it does not automatically grant U.S. citizenship. Once an EB-5 investor becomes a conditional permanent resident and later removes the conditions on their green card, they can pursue U.S. citizenship through the naturalization process.
The EB-5 journey begins with the filing of Form I-526, Immigrant Petition by Alien Investor. This petition is submitted to the U.S. Citizenship and Immigration Services (USCIS).
Once the I-526 petition is approved, the investor and their immediate family members (spouse and unmarried children under 21) receive conditional permanent resident status. This status is valid for two years.
During the two-year period of conditional permanent residency, investors and their families can live, work, and study in the United States.
To transition from conditional to unconditional permanent residency, investors must file Form I-829 within the 90-day period immediately preceding the second anniversary of their admission as conditional permanent residents.
If the I-829 petition is approved, USCIS removes the conditions on the green cards, and investors and their families become unconditional permanent residents.
After obtaining unconditional permanent residency, EB-5 investors and their family members can choose to pursue U.S. citizenship through the naturalization process .
Eligible permanent residents can apply for U.S. citizenship by submitting Form N-400, Application for Naturalization, to USCIS.
USCIS reviews the application, conducts background checks, and schedules interviews and tests as necessary.
If the application is approved, the applicant takes the Oath of Allegiance to become a U.S. citizen.
Naturalization is a separate process from the EB-5 program, and individuals should consult with immigration attorneys and USCIS for detailed guidance on the naturalization process and requirements..
